Patient Rights and Responsibilities

As a patient at the CARES Surgicenter, you have the following rights:

1. To be given a written copy of these rights and explanation of any you do not understand.
2. To be informed of services available in the facility, of names and professional status of the personnel providing and/or responsible for your care, fees and related charges, including the payment fee, deposit, and refund policy of the CARES Surgicenter, and any charges for services not covered by sources of third party payment or not covered by the facility basic rate. 
3. To be informed if the CARES Surgicenter has authorized other healthcare and educational institutions to participate in the patient’s treatment. You also shall have the right to know the identity and function of these institutions and to refuse to allow their participation in your treatment.
4. To receive from your physician(s), in terms that you understand, an explanation of your complete medical/health condition or diagnosis, recommended treatment, treatment options, including the option of no treatment, risk(s) of treatment, and expected result(s). If this information would be detrimental to your health, or if you are not capable of understanding the information, the explanation shall be provided to your healthcare provider. If you are not capable of understanding the information, the explanation shall be provided to the next of kin or guardian. This release of information to the next of kin or guardian, along with reason for not informing you directly, shall be documented in your medical record. 
5. To participate in the planning of your care and treatment, and to refuse medication and treatment. Such refusal shall be documented in your medical record. 
6. To be included in experimental research only when you give informed, written consent to such participation, or when your guardian gives such consent, if you are unable, in accordance with law, rule, and regulation. You may refuse to participate in experimental research, including the investigation of new drugs and medical devices. 
7. To resolve grievances or recommend changes in policies and services to facility personnel, the governing authority, and/or outside representatives of your choice either individually or as a group, and free from restraint, interference, coercion, discrimination, or reprisal. 
8. To be free from mental and physical abuse, free from exploitation, and free from use of restraints unless they are authorized by a physician for a limited period of time to protect you or others from injury. Drugs and other medications shall not be used for discipline or for convenience of facility personnel. 
9. To confidential treatment of information about you. Information in your medical record shall not be released to anyone outside of the CARES Surgicenter without your approval, unless another healthcare facility to which you are transferred requires the information, or unless the release of the information is required and permitted by law, a third-party payment contract, or a peer review, or unless the information is needed by New Jersey State Department of Health for statutorily authorized purposes. The facility may release data about you for studies containing aggregated statistics when your identity is masked. 
10. To be treated with courtesy, consideration respect and recognition of your dignity, individuality, and right to privacy. Your privacy shall be respected when facility personnel are discussing you and your care. 
11. To not be required to perform work for the facility unless the work is part of your treatment and is performed voluntarily by your. Such work shall be in accordance with local, state, and federal laws and rules.
12. To exercise civil and religious liberties, including the right to independent personal decision. No religious belief or practices, or any attendance at religious services, shall be imposed upon you. 
13. To not be discriminated against because of age, race, religion, sex, nationality, or ability to pay, or deprived of any constitutional, civil, and/or legal rights solely because of receiving services from the CARES Surgicenter.
14. To expect and receive appropriate assessment, management and treatment of pain.

Derechos Del Paciente

 Como paciente de CARES Surgicenter usted tiene los siguiente derechos: 

1. A que le den una copia de estos derechos y le expliquen cualquiera que no entienda. 
2. A que le informen sobre los servicios disponibles en la institución, los nombres y categoría professional del personal que le prove cuidados o que está a cargo de ellos, los costos y gastos correspondientes, en los que se incluye el pago, costo, depósito y método de devolución que tien CARES Surgicenter y cualquier cargo pro servicios que no paguen terceras partes o aquéllos que sobrepasen los costos básicos de la institución. 
3. A que le digan si CARES Servicenter ha autorizado a otras instituciónes educativas y de salud para que participen en el tratamiento del paciente. También tien derecho de averguar la identidad y funciones de estas instituciónes y rechazar la participación de las mismas en su tratamiento. 
4. A que su médico(s) le explique(n) de manera que usted entienda todo lo que se refiera a su condición médica o de salud o a su diagnóstico, el tratamiento recomendado, las opciones de tratamiento, incluyendo la opción de no recibir tratamiento, el riesgo o riesgos del tratamiento y los resultados que se puedan esperar. Si esa informactión fuera prejudicial para su salud o si usted fuera incapaz de entenderla, dicha explicación se dará a su parienta más cercano o a un tutor. En su historial clinico debe constrar que esta informacion se ha dado a conocer a dicho pariente o tutor, junto con la razón por la cual no se le informó a usted directamente.
5. A participar en los planes de su cuidado y tratamiento o a negarse a recibir medicación y tratamiento. Dicho rechazo quedará reflejado en su historial clínico.
6. A que sólo se le incluya en una investigación experimental si usted, después de haber sido debidamente informado, da consentimiento por escrito para tal participación o sis u totor da tal consentimiento de acuerdo con la ley, las reglas y los reglamentos en caso de que usted sea incapaz de hacerlo. Usted puede negarse a participar en investigación experimental incluyendo las investigación de nuevos medicamentos y asparatos.
7. A expresar sus quejas o a recomendar cambios en los metodos y servicios al personal de las institución, a las autoridades que las gobiernan o a cualquier repressentate externo que usted elija bien sea individualmente o como parte de un grupo, libre de restricción, interferencia, coerción, descriminación o respresalias.
8. A permanecer libŕe de abuso fisico y mental, de explotación y del uso de elementos de restricción, a menos que lo haya autorizado un médico durante un periodo de tiempo limitado para protegerle a usted y a otros de sufrir lesiones. No se usarán drogas o medicamentos como medios de desiciplina o por conveniencia del personal de las institución.
9. A que la información sobre usted se trate de manera confidencial. La información contenida en su historial clínico no se dará a conocer a nadie fuera de CARES Surgicenter sin su consentimiento, a menos que la requiera otra institución de salud a la que se le transfiera, o a menos que dicha informacion esté permitida por la ley y se necesite para: un pago de tercera parte, una revisión de grupo o a menos que la información las necesite el Departamento de Salud del estatdo de Nueva Jersey con propósitos autorizados por los estatutos, en cuyo caso la institución puede dar a conocer sus datos para estudios que contengan estadísticas agregadas siempre y cuando se mantenga anónima su identidad.
10. A que se le trate con cortesía, consideración y respeto y a que se reconozca su dignidad, individualidad y el derecho a su intimidad, que incluye pero no se limita a su intimidad auditiva y visual. Su intimidad deberá respetarse cuando el personal de la institución hable de usted y de sus cuidados.
11. A que no le hagan trabajar para la institución a menos que el trabajo sea parte de su tratamiento y usted lo haga voluntariamente, dicho trabajo deberá estar de acuerdo con las leyes y reglas locales, estatales y federales.
12. A que ejerza sus derechos civiles y religiosos, incluyendo el derecho a tomar decisions personales independientes. No se le impondrá ninguna creencia o práctica religiosa ni se le obligará a asistir a ningún srvicio religioso.
13. A que no se discrimine contra usted por razones de edad, raza, religión, sexo, nacionalidad o capacidad de pagar, o a que no se le prive de cualquier drecho constitucional, civil y legal solmente porque esté recibiendo servicios de CARES Servicenter.
14. Para esperar y recibir evaluacion apropriada, la gestion y el tratamiento de dolor.
